Terms of Service

Introduction

These Terms of Service govern your access to and use of Skeleton Draft, including our website, app, writing tools, structure tools, AI-assisted features, subscriptions, exports, and related services.

By creating an account, using Skeleton Draft, starting a subscription, or accessing the service, you agree to these Terms. If you do not agree, do not use Skeleton Draft.

Skeleton Draft is operated by Vive Content LLC, referred to in these Terms as "Skeleton Draft," "we," "us," or "our."

1. What Skeleton Draft is

Skeleton Draft is a structure-first writing and drafting tool. It is designed to help writers organize stories, projects, ideas, notes, outlines, drafts, scenes, beats, and related creative material.

Skeleton Draft is not a publisher, literary agent, legal adviser, copyright clearance service, or final-format professional writing platform. It is a creative tool. You are responsible for how you use it and for the work you create with it.

2. Who may use Skeleton Draft

You must be at least 13 years old to use Skeleton Draft.

If you are under the age of majority where you live, you may use Skeleton Draft only with permission from a parent or legal guardian.

You may not use Skeleton Draft if you are legally prohibited from using the service, if we have previously suspended or terminated your account, or if your use would violate applicable law.

3. Your account

You are responsible for your account, your login credentials, and all activity that happens under your account.

You agree to provide accurate account information and to keep that information reasonably current. You may not share your account in a way that avoids plan limits, billing requirements, or other restrictions.

If you believe your account has been accessed without permission, contact us promptly at theskeletondraft@gmail.com.

4. Your work remains yours

Your writing remains yours.

You retain ownership of your projects, drafts, notes, outlines, characters, scenes, story ideas, exports, and other original creative material you create or upload through Skeleton Draft.

We do not claim ownership of your writing.

Using Skeleton Draft does not transfer your copyright, authorship, or creative rights to us.

5. We will not train AI on your writing

We will never use your writing to train AI models.

Your projects, drafts, notes, outlines, characters, scenes, story ideas, exports, and other creative material are not used by Skeleton Draft to train AI models.

This applies whether you use Skeleton Draft with AI features enabled or disabled.

If you choose to use an AI-assisted feature, the content you intentionally submit or make available for that interaction may be processed to generate a response. That processing is for the purpose of providing the requested AI-assisted feature. It is not permission for Skeleton Draft to train AI on your writing.

6. Permission needed to operate the service

In order to provide Skeleton Draft, you give us limited permission to host, store, process, display, back up, transmit, and otherwise handle your content only as needed to operate, maintain, secure, improve, and provide the service.

This permission is not ownership. It exists so the app can function.

For example, this permission allows us to save your drafts, show your projects in your account, process exports, maintain backups, troubleshoot issues, and provide features you choose to use.

This permission does not allow us to sell your writing, publish your writing, claim ownership of your writing, or use your writing to train AI models.

7. Your responsibility for your work

You are responsible for your own content and how you use it.

You are responsible for reviewing, editing, verifying, backing up, exporting, publishing, submitting, sharing, or otherwise using any material created, stored, organized, or assisted through Skeleton Draft.

Skeleton Draft does not guarantee that your work is original, publishable, commercially viable, legally safe, free of infringement risk, or suitable for any particular purpose.

You are responsible for obtaining any rights, permissions, clearances, or professional advice needed for your project.

8. Backups and exports

Skeleton Draft is designed to help preserve drafts, snapshots, notes, and project material, but it is not a guaranteed archival storage service.

You should regularly export important work and keep your own backups.

We work to protect user data and maintain reliable systems, but we cannot guarantee that content will never be lost, corrupted, unavailable, accidentally deleted, or affected by bugs, outages, provider issues, account issues, or user error.

Before deleting an account, canceling a plan, changing billing status, or making major project changes, export any work you want to keep.

9. AI-assisted features

Skeleton Draft may include optional AI-assisted tools, currently Distill, Refine, Seed, Render, and Format.

AI does not automatically interact with your work. You must choose a tool on a specific piece of text.

AI is intended to condense, trim, and format words you have already written. It is not intended to replace the writer.

You are responsible for deciding whether to use AI-assisted material and for reviewing, editing, accepting, rejecting, or modifying any AI-assisted output.

AI-assisted output may be inaccurate, incomplete, repetitive, generic, inappropriate, similar to existing material, or unsuitable for your intended use.

Skeleton Draft does not guarantee that AI-assisted output is original, copyright-safe, publication-ready, legally compliant, factually accurate, or free of third-party claims.

10. AI providers and your content

When you choose to use AI-assisted features, selected content and minimal related context may need to be processed by a third-party AI provider in order to generate a response.

Skeleton Draft currently uses Anthropic Claude through a commercial API configuration to power optional AI-assisted features.

The exact data sent may depend on the feature used, the context selected, your settings, and the technical requirements of the service.

Do not use AI-assisted features with content you are not comfortable processing through those systems.

Skeleton Draft does not use your writing to train AI models.

We use commercial/API configurations from third-party AI providers that are designed not to use user-submitted content for model training by default. Based on its published commercial/API data practices, Anthropic states that it does not use business/API inputs and outputs to train its models by default.

Third-party AI providers may retain API inputs, outputs, and related technical data for limited periods for purposes such as abuse monitoring, safety, debugging, security, service operation, or legal compliance, depending on their current policies and the way the feature is used. These retention and processing practices are controlled by the third-party provider, not solely by Skeleton Draft.

Using an AI-assisted feature means you authorize the selected content, prompt, and necessary project context to be processed by the relevant AI provider for the purpose of generating the requested response.

We will describe relevant AI data practices in our Privacy Policy where appropriate.

If there is any conflict between these Terms and the Privacy Policy about how personal information is handled, the Privacy Policy will control for that issue.

11. Boundaries of AI within Skeleton Draft

Skeleton Draft limits where AI can operate inside the app.

AI tools work only on the text you choose. They must not invent, add, or rewrite story material, and dialogue words must stay verbatim.

AI features are provided as tools. They do not create a writing partnership, authorship relationship, agency relationship, publishing relationship, or professional advisory relationship between you and Skeleton Draft.

12. Acceptable use

You agree not to misuse Skeleton Draft.

You may not use the service to:

  • Violate any law or regulation
  • Infringe or misappropriate someone else's rights
  • Upload malware, harmful code, or destructive files
  • Attempt to access accounts, systems, data, or areas you are not authorized to access
  • Scrape, copy, harvest, or extract data from the service except through features we provide
  • Reverse engineer, decompile, or attempt to discover the source code or underlying systems except where legally permitted
  • Circumvent plan limits, usage limits, billing systems, AI credit limits, security features, or access restrictions
  • Interfere with or disrupt the service
  • Abuse, threaten, harass, exploit, or harm others
  • Use the service to generate, store, or distribute unlawful, abusive, exploitative, or harmful material
  • Resell, sublicense, or commercially exploit the service without written permission from us

We may suspend or terminate accounts that violate these Terms or create risk for Skeleton Draft, other users, third-party providers, or the public.

13. Subscriptions and paid plans

Skeleton Draft may offer free and paid plans.

Paid plans may include access to additional features, higher limits, AI credits, exports, storage, or other benefits.

Subscription plans renew automatically unless canceled before the renewal date. By starting a paid plan, you authorize our billing provider to charge your payment method for recurring fees, applicable taxes, and any other charges disclosed at checkout.

Plan prices, limits, features, AI credits, storage limits, and included services may change as Skeleton Draft develops. If we make material changes to a paid plan, we will try to provide reasonable notice where required or appropriate.

14. Billing provider

Payments are processed by a third-party billing provider, such as Stripe.

We do not directly store your full payment card details. Your payment information is handled by the billing provider according to its own terms and privacy practices.

If a payment fails, your account may lose access to paid features, be downgraded, or be suspended until billing is resolved.

15. Cancellation

You may cancel a paid subscription through the billing portal or account settings where cancellation is made available.

Canceling a subscription stops future renewal charges. It does not automatically refund past charges.

After cancellation, you may continue to have access to paid features until the end of the current billing period unless otherwise stated at checkout or required by law.

Canceling a plan does not intentionally delete your writing, but you should export important projects before making account or billing changes.

16. Refund policy

Payments are generally non-refundable except where required by law or where we decide otherwise in our discretion.

If something went wrong with billing, account access, duplicate charges, failed cancellation, or service availability, contact us at theskeletondraft@gmail.com. We will review the request in good faith.

We do not guarantee refunds for unused time, partially used billing periods, forgotten cancellations, dissatisfaction with features, AI results, writing outcomes, or changes in personal circumstances.

17. Free trials, promotions, and credits

Skeleton Draft may offer free trials, promotional pricing, discounts, AI credits, or other limited offers.

Unless stated otherwise, promotions are temporary, may be limited to certain users, may not be transferable, and may be changed or discontinued at any time.

If a free trial converts into a paid subscription, the renewal terms, price, billing period, and cancellation process should be disclosed at signup. You are responsible for canceling before the trial ends if you do not want to be charged.

AI credits, if offered, may expire, reset, be limited by plan, or change over time.

18. Changes to the service

Skeleton Draft is an evolving product.

We may add, remove, modify, rename, redesign, limit, or discontinue features at any time. This may include changes to structure tools, drafting tools, AI features, exports, plan limits, project limits, storage limits, credit systems, or interface design.

We are not required to continue offering any specific feature forever.

19. Availability

We work to keep Skeleton Draft available, reliable, and secure, but the service is provided without a guarantee of uninterrupted access.

The service may be unavailable due to maintenance, updates, outages, bugs, security issues, third-party provider failures, internet disruptions, billing issues, or events outside our control.

We are not responsible for losses caused by downtime, delay, interruption, data loss, or inability to access the service, except where liability cannot be excluded by law.

20. Third-party services

Skeleton Draft may rely on third-party services for hosting, databases, authentication, billing, AI processing, analytics, email, storage, deployment, security, and other functions.

These third-party services may include, without limitation, providers for payment processing, hosting, databases, AI processing, and other infrastructure.

Your use of Skeleton Draft may be affected by those third-party services. We are not responsible for third-party outages, errors, security incidents, policy changes, pricing changes, or service limitations.

Third-party services may have their own terms and privacy policies.

21. Skeleton Draft intellectual property

Skeleton Draft, including the app, website, interface, design, branding, logos, names, mascots, structure systems, product concepts, features, workflows, code, copy, and other materials we provide, belongs to Skeleton Draft or its licensors.

You may not copy, reproduce, modify, distribute, sell, lease, reverse engineer, or create derivative works based on Skeleton Draft except as allowed by these Terms or with our written permission.

These Terms do not give you ownership of Skeleton Draft's intellectual property.

22. Feedback

If you send us feedback, ideas, suggestions, bug reports, feature requests, or other comments, you give us permission to use them without restriction or compensation.

This does not give us ownership of your creative writing or project content. It only applies to feedback about Skeleton Draft.

We will not use your private project content as "feedback" unless you intentionally submit it to us for that purpose.

23. Privacy

Your use of Skeleton Draft is also governed by our Privacy Policy.

The Privacy Policy explains how we collect, use, store, share, and protect personal information.

Our Privacy Policy should also explain our AI data practices, including the fact that Skeleton Draft does not use your writing to train AI models.

Please read it carefully. If you do not agree with the Privacy Policy, do not use Skeleton Draft.

24. Termination

You may stop using Skeleton Draft at any time.

We may suspend or terminate your account if you violate these Terms, create legal or security risk, misuse the service, fail to pay required fees, or use the service in a way that could harm Skeleton Draft, users, third-party providers, or others.

If your account is terminated, you may lose access to your projects, drafts, notes, exports, AI credits, settings, and other account data.

Where reasonable and legally permitted, we may provide an opportunity to export your content before termination, but we are not required to do so in every situation.

25. Disclaimers

Skeleton Draft is provided "as is" and "as available."

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, reliability, accuracy, and error-free operation.

We do not guarantee that Skeleton Draft will meet your needs, improve your writing, complete your project, produce publishable work, preserve all content, prevent all errors, or generate any particular creative, professional, commercial, or personal outcome.

26. Limitation of liability

To the fullest extent permitted by law, Skeleton Draft and its owners, employees, contractors, partners, vendors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost business opportunities, lost data, lost content, lost goodwill, service interruption, or creative or commercial losses.

To the fullest extent permitted by law, our total liability for any claim related to Skeleton Draft will not exceed the greater of:

  • The amount you paid to Skeleton Draft in the three months before the claim arose, or
  • $100

Some jurisdictions do not allow certain limitations of liability, so some of these limits may not apply to you.

27. Indemnity

You agree to defend, indemnify, and hold harmless Skeleton Draft and its owners, employees, contractors, partners, vendors, and affiliates from claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from:

  • Your use or misuse of Skeleton Draft
  • Your content
  • Your violation of these Terms
  • Your violation of law
  • Your violation of someone else's rights
  • Your publication, submission, distribution, sale, or other use of material created, stored, organized, exported, or assisted through Skeleton Draft

28. Changes to these Terms

We may update these Terms as Skeleton Draft changes.

When we make changes, we will update the "Last updated" date above. If changes are material, we may provide additional notice, such as through the app, website, email, or account notice.

Your continued use of Skeleton Draft after updated Terms become effective means you accept the updated Terms.

If you do not agree to the updated Terms, stop using Skeleton Draft.

29. Governing law

These Terms are governed by the laws of Arizona, United States of America, without regard to conflict of law rules, except where local law requires otherwise.

Any dispute related to these Terms or Skeleton Draft will be handled in the courts located in Yavapai County, Arizona, United States of America, unless applicable law requires a different venue.
